Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and InsightBite ("we," "us," or "our") regarding your use of the InsightBite mobile application and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

InsightBite is an AI-powered nutrition tracking application that allows users to:

• Log meals using natural language descriptions
• Receive automated nutritional analysis including calories, protein, carbohydrates, and fats
• Track daily nutritional intake and progress toward personal health goals
• Access personalized insights and analytics
• Set and monitor custom nutrition goals

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for any reason.

3. Eligibility

You must meet the following requirements to use the Service:

• You must be at least 13 years of age (or the age of majority in your jurisdiction, whichever is greater)
• If you are under 18, you must have permission from a parent or legal guardian
• You must be legally capable of entering into binding contracts
• You must not be barred from using the Service under applicable law

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Service, you must create an account by providing accurate and complete information, including a valid email address and password.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information remains accurate and up-to-date

4.3 Account Restrictions

• You may not share your account with others
• You may not create multiple accounts to circumvent restrictions
• You may not use another person's account without permission
• You may not transfer or sell your account to others

5. Subscription and Payment

5.1 Free Trial

New users may be eligible for a limited free trial allowing analysis of a set number of meals. After the trial period, continued use requires a paid subscription.

5.2 Subscription Plans

We offer various subscription plans with different features and pricing. Subscription fees are clearly displayed in the app before purchase.

5.3 Payment Processing

• Payments are processed through Apple App Store or Google Play Store
• Payment terms are governed by the respective app store's policies
• We use RevenueCat to manage subscriptions
• All fees are non-refundable except as required by law or specified in these Terms

5.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through your app store account settings.

5.5 Price Changes

We reserve the right to modify subscription prices with at least 30 days' notice. Price changes will not affect your current subscription period but will apply upon renewal.

5.6 Refunds

Refund requests should be directed to Apple or Google, as applicable. We do not directly process refunds for app store purchases. Refund eligibility is determined by app store policies.

6. User Content and Conduct

6.1 Your Content

You retain ownership of all meal descriptions, food logs, and other content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely to provide and improve the Service.

6.2 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Submit false, misleading, or harmful content
• Attempt to interfere with or disrupt the Service
• Use automated systems to access the Service without authorization
• Reverse engineer, decompile, or disassemble any aspect of the Service

6.3 Content Moderation

We reserve the right, but are not obligated, to monitor, review, or remove User Content that violates these Terms or is otherwise objectionable.

7. AI Analysis and Accuracy Disclaimer

7.1 AI-Powered Analysis

InsightBite uses artificial intelligence (specifically OpenAI's API) to analyze meal descriptions and estimate nutritional content. While we strive for accuracy, AI-generated nutritional information is an estimate and may not be 100% accurate.

7.2 Not Medical Advice

IMPORTANT: The Service is not intended to provide medical, nutritional, or dietary advice. The information provided is for informational purposes only and should not replace consultation with qualified healthcare professionals.

7.3 User Responsibility

You acknowledge and agree that:

• Nutritional estimates may vary from actual values
• You should consult healthcare providers before making significant dietary changes
• The Service is not suitable for medical diagnosis or treatment
• You use the Service at your own risk
• We are not responsible for decisions made based on Service information

7.4 Third-Party AI Processing

Your meal descriptions are processed by OpenAI's API. By using the Service, you acknowledge that your meal descriptions will be sent to OpenAI for analysis, subject to OpenAI's terms and privacy policy.

8. Intellectual Property Rights

8.1 Our Rights

The Service, including all content, features, functionality, software, code, and design, is owned by InsightBite and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Service
• Distribute, sell, or lease any part of the Service
• Remove or alter any proprietary notices
• Use the Service to develop competing products

8.4 Trademarks

InsightBite and associated logos are trademarks of InsightBite. You may not use our trademarks without prior written permission.

9. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws, regulations, or these Terms
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or other harmful code
• Collect or harvest user information without consent
• Interfere with or disrupt servers, networks, or the Service
• Bypass security measures or access restricted areas
• Use the Service for commercial purposes without authorization
• Engage in fraudulent activities or abuse trial offers
• Scrape, spider, or crawl the Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in app settings
• Contacting us at support@insightbite.info

Termination does not entitle you to a refund of any subscription fees.

10.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account poses a security risk
• We are required to do so by law

10.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and User Content
• You remain liable for any obligations incurred before termination
• Sections of these Terms that should survive will continue to apply

11. Disclaimers and Limitations

11.1 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Warranty

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors will be corrected
• The Service will meet your requirements

11.3 Third-Party Services

The Service relies on third-party services (OpenAI, Supabase, RevenueCat). We are not responsible for any issues arising from these third-party services.

12. Indemnification

You agree to indemnify, defend, and hold harmless InsightBite, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Your violation of applicable laws

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSIGHTBITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InsightBite operates, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@insightbite.info to seek informal resolution of any dispute.

14.3 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial and to participate in class actions.

14.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date
• Notify you through the app or via email
• Provide a reasonable period to review changes before they take effect

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and InsightBite regarding the Service

• Waiver: Our failure to enforce any provision does not waive our right to do so later
• Assignment: You may not assign these Terms; we may assign them without restriction
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our control
